1. Acceptance of Terms
Nox (the "Service") is provided by Xhealth, Inc., operating the Nox product ("Xhealth", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms and Conditions and by our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Nox is an AI‑powered health and wellness assistant that provides general health, wellness, nutrition, fitness, and lifestyle information. Nox is intended to supplement — not replace — professional medical advice, diagnosis, or treatment.
3. Medical Disclaimer
Information provided by Nox is for general informational and educational purposes only and is not medical advice. Using Nox does not create a doctor–patient or other professional relationship.
Always seek the advice of your physician or another qualified health provider with any questions about a medical condition. Never disregard professional medical advice or delay seeking it because of something Nox said.
If you think you may have a medical emergency, call your doctor or emergency services immediately.
4. Not a Medical Device; No HIPAA
- Nox is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease.
- Nox does not provide clinical, diagnostic, or emergency services.
- Xhealth, Inc. is not a HIPAA covered entity, and the Service is not HIPAA‑regulated. How we handle your information is described in our Privacy Policy.
5. Nature of the Service; Limitations
Nox is an educational and wellness service that is continually evolving. You acknowledge and accept the following:
- Answers may be incomplete, outdated, or wrong, and may not fit your individual circumstances.
- Features may change, be added, or be removed at any time, and the Service may be unavailable or interrupted.
- Data‑handling practices may evolve as the product matures; we will update this and the Privacy Policy accordingly.
- Automated medical‑safety guardrails (such as emergency or red‑flag warnings) may fail to trigger or may trigger incorrectly.
- You should not rely on Nox for urgent, serious, or high‑stakes decisions. For anything serious, consult a qualified professional.
We publish how these safety guardrails are built, measured, and governed — including their limitations — on our Trust & Transparency page.
6. AI‑Generated Content
Responses are generated by AI models and may contain errors or "hallucinations." You are responsible for evaluating the accuracy and appropriateness of any output before relying on it. Do not submit content you are not authorized to share.
7. Eligibility
You must be at least 18 years old to use the Service. By using Nox, you represent that you are at least 18 and have the legal capacity to enter into these Terms.
8. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us immediately of any unauthorized use. We are not liable for losses arising from unauthorized use of your account.
9. Acceptable Use
You agree not to:
- Submit false, misleading, or harmful information
- Attempt to access unauthorized areas of the platform
- Disrupt or interfere with the Service or its security
- Use automated systems to access the Service without permission
- Use the Service to provide medical care to others or as a substitute for professional judgment
- Violate any applicable local, national, or international law
10. Subscriptions & Payments
Paid plans (such as Pro and MAX) are billed through Stripe on a recurring basis until cancelled. By subscribing, you authorize recurring charges to your payment method. You can manage, change, or cancel your subscription at any time through the billing portal in the app; cancellation takes effect at the end of the current billing period. Prices and plan features may change with notice.
Free trial and automatic renewal. New customers may be offered a 7‑day free trial of Nox Pro. You must provide a valid payment method to start the trial, and only one free trial is available per user. Unless you cancel before the trial ends, your subscription will automatically convert to a paid Nox Pro plan and your payment method will be charged $5.99 per month. The subscription then renews automatically each month at the then‑current price until you cancel. You can cancel at any time — including during the trial — from the billing portal in Settings, and cancellation takes effect at the end of the current trial or billing period. We do not provide prorated refunds for partial periods except where required by law.
11. Intellectual Property
All content, branding, and materials associated with Nox and Xhealth, Inc. are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our explicit written permission. You retain ownership of the content you submit, and you grant us a limited license to process it to operate and improve the Service as described in the Privacy Policy.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, error‑free, or that any information provided is accurate or complete.
13. Limitation of Liability
To the fullest extent permitted by law, Xhealth, Inc. and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of, or inability to use, the Service or any reliance on its output. Your sole remedy for dissatisfaction with the Service is to stop using it.
14. Indemnification
You agree to indemnify and hold harmless Xhealth, Inc. and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to its conflict‑of‑laws rules.
Before filing any claim, you agree to first contact us at Info@Xhealthus.com and attempt to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California, unless otherwise required by applicable law.
16. Termination
We may suspend or terminate your access to the Service at any time for conduct that violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service and delete your account at any time from Settings.
17. Changes to Terms
We may modify these Terms from time to time. We will update the "Last updated" date and, for material changes, provide notice in the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.
